Introduction

Welcome to FleaBid ("we", "us", "our"). By accessing or using our platform, you agree to the following Terms & Conditions. These terms apply to all users, including bidders and sellers, and are intended to ensure fairness, safety, and transparency across all FleaBid auctions.

1. Registration & Account

• Users must be at least 18 years old to participate.
• All bidders and sellers must create an account and provide accurate, up-to-date information.
• You are responsible for maintaining the confidentiality of your account and for all activities under it.
• FleaBid reserves the right to suspend or remove accounts that violate platform rules.

2. Item Listings & Descriptions

• All items are sold "as is" and "where is" unless otherwise stated.
• Sellers are fully responsible for the accuracy of item descriptions, photos, and condition details.
• FleaBid does not guarantee the accuracy of any listing and is not liable for misdescribed items.
• Bidders are encouraged to ask questions and inspect details before placing a bid.

3. Bidding Rules

• All bids are binding and cannot be canceled or retracted.
• False bidding, collusion, or any attempt to manipulate pricing will result in immediate removal.
• Bidders may place manual bids or set a proxy bid allowing the system to auto-increment up to their maximum amount.
• Placing a bid signifies the bidder's intention and ability to complete the purchase.

4. Bid Increments

• Bid increments are set automatically based on price ranges established by FleaBid. Bids not meeting these increments may be rejected by the system.

5. Winning a Bid

• The highest valid bid at the end of the auction wins.
• Auction results are final. All sales are final.
• Winning bidders are responsible for the total amount due, including:
• Winning bid price
• Buyer's premium
• Applicable taxes
• Shipping or pickup arrangements

6. Payments

• FleaBid uses Stripe for secure payments.
• A valid payment method must be added before bidding.
• After winning, bidders must complete payment within 6 hours through their FleaBid account unless cash-on-pickup is explicitly allowed by the seller.
• Failure to pay may result in:
• Account suspension
• Cancellation of purchase
• Inability to participate in future auctions

7. Pickup & Shipping

• Every item is either Shipping Only, Pickup Only, or Shipping Available (as displayed on the listing).
• Pickup-only items must be collected within the pickup window displayed on the auction page.
• Bidders are responsible for verifying the pickup location is within acceptable distance before bidding.
• Failure to pick up may result in storage fees, disposal, or account suspension.

8. Seller Responsibilities

• Sellers must offer items as described and ensure safe, legal, and accessible pickup locations.
• Items must be available to the winning bidder at the specified pickup time.
• Sellers must communicate professionally through the FleaBid messaging system.
• Payment for sold items is released to sellers according to FleaBid's payout schedule via Stripe.

9. Disputes

• FleaBid may mediate disputes but is not responsible for enforcing private transactions.
• All decisions made by FleaBid regarding disputes, rule violations, or auction results are final.

10. Prohibited Items

Users may not list or bid on:

• Illegal or stolen goods
• Weapons or restricted items (unless compliant with state law)
• Counterfeit or fraudulent items
• Hazardous or unsafe materials
• Items violating FleaBid policies

11. Platform Usage

• Users must not manipulate auction results, use bots, scrape data, or interfere with platform operations.
• FleaBid cannot guarantee uninterrupted service and is not liable for technical difficulties, delayed internet, or bidding errors caused by the user.

12. Cancellations

• FleaBid may cancel or postpone auctions when necessary.
• In such events, users will be notified and payments will be refunded.

13. Liability

• FleaBid is not responsible for loss, theft, damage, or injury occurring at pickup locations.
• FleaBid is not liable for disputes between buyers and sellers.
• Participation in auctions is entirely at your own risk.

14. Governing Law

These Terms & Conditions are governed by the laws of the State of California. Any legal claims must be filed within California jurisdiction.

15. Changes to Terms

FleaBid may update these terms at any time. Continued use of the platform constitutes acceptance of any revised terms.
